1. Agreement to These Terms

These Terms of Service ("Terms") form a binding agreement between you ("you" or "the customer") and SwiftScript Enterprise ("SwiftScript", "we", "us", or "our"), an online retail business operating in Ghana. By visiting our website, browsing our catalogue, creating an account, or placing an order, you agree to these Terms in full. If you do not agree with any part of them, please don't use the site or place an order — and feel free to reach out to us with questions first.

2. About SwiftScript Enterprise

SwiftScript is an online store selling clothing, shoes, bags, electronics, beauty and personal care items, fragrances, kids' products, and home goods to customers across Ghana. We operate exclusively online through this website and our social channels — we do not have a walk-in retail location unless we tell you otherwise for a specific order.

3. Eligibility & Your Information

• You must be at least 18 years old, or placing an order with the involvement of a parent or guardian, to buy from SwiftScript.
• You agree to provide accurate, current information when checking out — name, phone number, delivery address, and payment details — so we can actually get your order to you.
• You're responsible for keeping any login or account details you create with us confidential, and for all activity carried out under your account or contact details.
• We reserve the right to refuse service, cancel an order, or close an account where we reasonably suspect fraud, abuse, repeated failed deliveries, or a breach of these Terms.

4. Products, Pricing & Availability

• All prices are listed in Ghana Cedis (GHS) and may change at any time without prior notice. The price charged is the one shown at checkout at the time you place your order.
• We try hard to photograph and describe products accurately, but slight variations in colour, texture, or packaging between the photo and the item you receive can happen — this is normal for real retail photography, not a defect, unless the item is genuinely different from what was described.
• Stock levels shown on the site are updated regularly but are not a guarantee. If an item you ordered turns out to be unavailable, we'll contact you to offer a substitute, a pre-order timeline, or a full refund.
• Featured placement, "Hot Pick" tags, and similar labels reflect real signals like stock levels or merchandising choices — not a claim about any specific discount percentage unless one is explicitly stated on the product.
• In the rare case a product is listed at an incorrect price due to a technical or human error, we reserve the right to cancel the order and issue a full refund, even if the order was already confirmed.

5. Orders & Payment

We currently accept the following payment methods:

We never see or store your full card or Mobile Money PIN — card and Mobile Money payments are processed directly by Paystack, a licensed Ghanaian payment processor, under its own security standards. An order is only confirmed once payment is successfully received (or, for Cash on Delivery, once we've accepted the order). We reserve the right to decline or cancel any order before dispatch, with a full refund where payment was already made.

6. Shipping & Delivery

• Delivery times shown at checkout and in order confirmations are estimates, not guarantees — actual delivery can be affected by traffic, weather, courier capacity, or incorrect address details.
• You're responsible for providing a complete and accurate delivery address and a reachable phone number. We are not liable for delays or failed delivery caused by incorrect information you provided.
• Risk of loss and ownership of an item passes to you once it has been delivered to the address you provided, or handed to you or someone at that address.

8. Bulk & Wholesale Orders

Products marked with wholesale pricing offer a lower per-unit price at the listed minimum quantity. Wholesale pricing is intended for genuine bulk purchases and may be adjusted or withdrawn for orders we reasonably believe are being placed to abuse the pricing (for example, splitting one bulk order into many small ones). For larger custom bulk arrangements, contact us directly before ordering.

9. Promotions & Communications

• Seasonal banners, countdowns, and "limited stock" messaging on our site reflect real promotions or real stock levels at the time they're shown — we don't fabricate discount percentages or stock counts.
• By placing an order or contacting us on WhatsApp, you may receive order-related messages (confirmations, delivery updates) via SMS, WhatsApp, or email. You can opt out of marketing messages at any time by telling us directly — order-related updates for an active order will still be sent.

10. Acceptable Use

When using our site, you agree not to:

• Provide false information, impersonate another person, or place fraudulent orders;
• Attempt to interfere with, hack, or disrupt the site, its checkout, or payment processing;
• Scrape, copy, or republish our product catalogue, photos, or pricing for a competing commercial purpose without our written permission;
• Use the site for any unlawful purpose under the laws of Ghana.

11. Reviews & Customer Content

If you submit a product review, photo, or other content to us, you confirm it's honest, your own, and not defamatory or unlawful, and you grant SwiftScript a non-exclusive right to display it on our site and social channels. We may remove any review or content that is fake, abusive, or violates these Terms, but we don't edit or fabricate reviews on customers' behalf.

12. Intellectual Property

The SwiftScript name, logo, site design, and original product photography and descriptions are owned by SwiftScript Enterprise or used under licence. You may not reproduce, redistribute, or use them commercially without our prior written consent. This does not affect your right to screenshot or share a product page for personal, non-commercial purposes — like showing a friend something you want to buy.

13. Third-Party Services

Our site links to and relies on third-party services — including Paystack for payments, and WhatsApp, Instagram, and TikTok for communication and social presence. Your use of those platforms is governed by their own terms and privacy policies, and we are not responsible for their availability, content, or practices.

14. Product Condition & Disclaimer

We stand behind the accuracy of our product descriptions and the condition of items at the time of dispatch, and our Return & Refund Policy covers defects and issues within the stated windows. Outside of what that policy and Ghanaian consumer protection law require, our site and products are otherwise provided without additional warranties, express or implied, to the fullest extent the law allows. Nothing in these Terms removes any right that Ghanaian law gives you as a consumer.

15. Limitation of Liability

To the fullest extent permitted under the laws of Ghana, SwiftScript Enterprise's total liability to you for any claim arising from an order is limited to the amount you actually paid for the product in question. We are not liable for indirect or consequential losses — such as lost time, lost opportunity, or inconvenience — arising from delays, stock issues, or site downtime, except where such liability cannot be excluded by law.

16. Indemnification

You agree to hold SwiftScript Enterprise harmless from any claim, loss, or expense (including reasonable legal costs) arising from your misuse of the site, violation of these Terms, or violation of any law or third party's rights.

17. Governing Law & Disputes

These Terms are governed by the laws of the Republic of Ghana. If a disagreement arises, we ask that you contact us first so we can try to resolve it directly and quickly — most issues are. If it can't be resolved that way, the courts of Ghana will have exclusive jurisdiction over the matter.

18. Changes to These Terms

We may update these Terms from time to time as our business grows — for example, to add new payment methods or delivery areas. The "Last updated" date at the top of this page will reflect the latest revision. Continuing to use the site or place orders after a change takes effect means you accept the updated Terms.
